Terms of Service

In these terms of service (“Terms of Service”), the words “you,” “your,” and “User” mean each and every person who accesses or uses any Service (as defined below), including any business or other entity on behalf of which any Service is accessed. The words “we,” “us,” “our,” and “Plaace” mean Plaace AS.
Please review these Terms of Service before using or accessing any products or services offered by Plaace (each, a “Service,” collectively “Services”), which include but are not limited to Plaace websites and the subdomains thereof (collectively, the “Site”)
All Services are provided by Plaace. By accessing or using any Service, including the Site Platform, you signify that you have read, understand and agree to be bound by these Terms of Service, regardless of whether you have registered with Plaace as a member.
IF YOU DO NOT AGREE TO THESE TERMS WITHOUT LIMITATION OR EXCLUSION OR TO ANY CHANGES TO THESE TERMS OF SERVICE, YOU MUST IMMEDIATELY EXIT THE SITE AND STOP USING THE SERVICE.
Changes to these Terms of Service
We may make changes to these Terms of Service from time to time. If we do this, we will post the changed Terms of Service on this page and will indicate at the top of this page the date the Terms of Service were last revised. You understand and agree that your continued use of any Service after we have made any such changes constitutes your acceptance of the new Terms of Service.
Individuals: If you are a natural person, all Services are intended solely for Users who are 18 years of age or older. Any registration by, use of or access to an Account or a Service by any natural person under 18 is unauthorized, unlicensed and in violation of these Terms of Service. By using any Service, you represent and warrant that, you are a natural person, aged 18 or older, and that you agree to and will abide by all of the terms and conditions of these Terms of Service. Individuals may only register for free accounts.
Business: If you are entering into these Terms of Service on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind such entity, its affiliates, and all users who access the Service through your account to these Terms of Service, in which case the terms “you” or “your” shall also refer to such entity, its affiliates, and users associated with it. If you do not have such authority, or if you do not agree with these Terms of Service, you must not accept these Terms of Service and you may not use the Service. You further agree that you assume all responsibility and liability in connection with your use of the Site or Service on behalf of such a company or other legal entity, and you shall be solely responsible for all disputes, if any, that arise due to your use of the Site or Service on behalf of such a company or other legal entity. You should register yourself with Plaace as a person of contact for the business on behalf of which you are accepting these Terms of Service.
Plaace offers through its Site a service that enables brokers, prospective tenants, and retail property owners to explore areas, concepts, or properties via data from a variety of sources.
Plaace offers free and paid subscription plans. The paid subscription plans are offered on a quarterly or yearly basis (“Service Period”). You will be able to choose your subscription plan while registering your account and will be able to upgrade your plan in your account. Plaace may add, remove, or change plans at any moment. In such cases, Plaace will notify you previously of the addition, removal, or change of plans.
We reserve the right at any time and from time to time to modify or discontinue, temporarily or permanently, any or all of the Services. We will notify you about significant changes before such changes come into force and give you a possibility to evaluate the effects of proposed changes and take necessary measures. Notification will be given through the Site, the Service, or by email.
We will not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service.
You are granted a non-exclusive, non-transferrable and time-limited access right to the Site and the Service. Your license and access reflect the subscription plan to which you have registered. The access right is time-limited to the duration of your account.
The access right granted here does not include the right to access the source code or object code, or otherwise access parts of the Site or Service which are not intentionally made available by us. The access right does not include the right to modify, reproduce, reverse-engineer, decompile, disassemble, copy, or imitate the Site or the Service.
We reserve the right to take various actions against you if we believe you have engaged in activities restricted in these Terms of Service and to protect us, other users, and other third parties from any liability, fees, fines, or penalties. Such actions may include, but are not limited to: updating information you have provided to us so that it is accurate, limiting or completely closing your access to the Site or the Services, or terminating your Account and your access to the Services.
To access our Services, you must create a user account with Plaace by providing your email address. In case of paid subscription plans, additional information may be necessary. This process will include creation of a login and password to access the Services. When you sign up for a user account, you agree to provide accurate, current and complete information, as may be prompted by any registration forms available through the Site, in connection with the Services or as otherwise requested by Plaace for such information (“User Information”). You further represent that you are a legal owner of, and that you are authorized to provide us with, all User Information and other information necessary to facilitate your use of the Site and Services. You authorize us to make any inquiries we consider necessary to validate your identity, if necessary. If you do not respond to such inquiries or we cannot verify your identity, we can refuse to allow you to use the Site and/or Services.
Your account is personal and is only meant for you. You may not share your log in details with third parties, nor register other people’s names, addresses or other contact information to your personal profile. The name, e-mail address and phone number that you submit to your personal profile shall be your own. You are responsible for ensuring that your information is correct and up to date. Your password and log-in detailed shall be stored in a safe location.
You are prohibited from using a login or password of another person to access the Site and/or Services. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to and accept sole responsibility for any and all activities that occur under your account or password. If you believe or have reason to believe that any of your User Information, including your login and/or password, has been compromised, or that another person is accessing your user account through some other means, you agree to notify us as soon as possible at email@example.com. However, you may be held liable for losses incurred by us due to someone else using your account or password.
If your User Information changes, you agree that you will update this information as soon as possible. To update your User Information, you should update your User Information in your account accordingly.
User Content and Data
We may allow you to post or publish content on or upload content to the Site or Service. Any content a user submits, posts, displays, or otherwise makes available on the Site or Service is referred to as “User Content.” You retain ownership of your User Content. For clarity, User Content also includes technical features and add-ons created by you in connection with your use of the Site or Service. You alone are responsible for any of your User Content that may be lost or unrecoverable through your use of the Site or Service.
All content posted on the Service must comply with Norwegian copyright law and other Norwegian laws. You agree that any User Content you post does not and will not violate any law or infringe any rights of any third party. If you think any User Content infringes your rights, or if you want to challenge User Content that has been taken down from the site, please contact us at firstname.lastname@example.org.
User Content together with other non-public data provided by User to Plaace shall be referred as “User Data.” User shall retain all right, title, and interest in and to User Data, as well as any data that is based on or derived from User Data. However, User hereby grants to Plaace a non-exclusive, non-transferable, worldwide, royalty-free, fully paid-up, perpetual, and irrevocable right and license to use such data in aggregated or de-identified form for the purposes of providing and improving the Services.
We claim no intellectual property rights over the material you or your business provide to the Service. Your profile and materials uploaded remain yours. However, by setting your pages or website to be shared publicly, you agree to allow others to view and share your User Content. We have no obligation to store, maintain, or provide you a copy of your User Content. We reserve the right but are not obligated, to reject and/or remove any User Content that we believe, in our sole discretion, violates these Terms of Service.
We do not pre-screen User Content, but we retain the right (but not the obligation) in our sole discretion to refuse or remove any User Content that is available via the Site or Service.
You represent, covenant, and warrant that (i) you will use the Site and the Service only in compliance with all applicable laws and regulations, and in a way that will not harm the Service or anyone else’s use of it; (ii) the information you provide us is true, accurate, and complete, as you are solely responsible for such information; and (iii) your use of the Site or Services do not violate any laws or regulations or any agreements with any third parties.
You further represent, covenant, and warrant that you will not (i) try to reverse engineer, disassemble, decompile, extract, or decipher the Site or the Services or software making up the Site and/or Services, (ii) navigate or search the Site or Services with any tool, software, agent, engine or other means (including bots, avatars, intelligent agents, or spiders), (iii) use a mean other than Plaace’s provided interface to access the Site or the Services, (iv) use the Site or the Services in a way that could impair, overburden, damage, or disable any portion of the Site or Services, or (v) copy or mirror any material contained on the Site or the Services.
Proprietary Rights in Service
We have either secured the rights or ownership to all Intellectual Property Rights (as defined below) and Know-How (as defined below)related to the Site and the Service, including, but not limited to rights and ownership to algorithms, source code, object code and accompanying documentation, user interface design, graphics, illustrations, data, drawings, images, sound, music, videos, concepts, techniques, and specifications. In addition, we have secured either rights or ownership to the trademark Plaace and any other trademarks used to market the Service and all domain names where the Service is hosted.
“Intellectual Property Rights” include, but are not limited to patent rights, design rights, and copyrights.
“Know-How” includes, but is not limited to all industrial, technical, marketing and commercial information and techniques in any form, and all designs and artistic creations, regardless of whether it is patentable, registered as Intellectual Property Rights or protected as trade secrets.
Subscription Fee, Payment Method, Change in Fee
Certain Services are subject to a subscription fee (the “Subscription Fee”). The subscription fee varies according to the subscription plan and may be billed on a quarterly or yearly basis depending on your choice of Service Period when registering, and excludes any taxes or VAT, which shall be charged by us as applicable.
In case you acquire a paid subscription plan, we require you to provide a valid debit or credit or other billing information to us. You are required to add your billing information to be able to use the paid Services. Your subscription will be billed on a quarterly or yearly basis, on or before the 15th of the first month of each Service Period for the Services to be accessed on such Service Period.
There are no refunds or credits for termination of your account before the end of the Service Period.
All fees are exclusive of all taxes, levels, or duties imposed by taxing authorities, except when otherwise required by mandatory law. You are responsible for payment of all such taxes, levies, or duties.
The Subscription Fee is subject to change upon thirty (30) days’ notice from us. Such notice may be provided at any time through the Site, the Service, or by email.
Cancellation and Termination
You are solely responsible for properly cancelling your account. Cancelation request must be done by contacting Plaace at email@example.com.
If you cancel the Service before the end of your current paid up month, your cancellation will take effect immediately and you will not be charged again.
